MOTHER DISCLIPLINED FOR EXCESS DISCIPLINE

In a case involving the Westchester County Family Court, the mother appealed an order dated August 8, 2023, which found her guilty of neglecting her two children, Moshae L. and Sephira L. 

The court's decision was based on evidence presented during fact-finding and dispositional hearings. The mother was accused of striking Moshae L. across the face in front of Sephira L. because he was being loud and did not want to sleep. Additionally, the mother, who suffers from mental health issues such as depression, PTSD, and anxiety, failed to follow prescribed medication and treatment plans. She also neglected to have Moshae L. evaluated for potential attention deficit disorder and autism despite medical advice.

The Family Court determined that the mother's actions constituted neglect and directed that the children remain in the custody of the Commissioner of Social Services of Westchester County. 

On appeal, the Appellate Division, Second Department, affirmed the outcome, emphasizing the credibility of the witnesses and the severity of the mother's actions, including the use of excessive corporal punishment and failure to address her mental health issues and the children's medical needs.
