NEW YORK BEER PROJECT AIN’T TOASTING THIS

COMPANY FIRED EMPLOYEES SUFFERING FROM CANCER AND SEIZURES

According to a lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) on April 24, 2024, New York Beer Project -- a restaurant, brewery and beer hall up in Victor, New York – is said to have fired a bartender because he had cancer, and another who suffered from nocturnal seizures, even though they had both been medically cleared to work.

Believing that such conduct violated the Americans with Disabilities Act (ADA), the EEOC filed suit in U.S. District Court for the Western District of New York (EEOC v. New York Beer Project, LLC, Civil Action No. 1:24-cv-00377), seeking monetary damages and injunctive relief.

In a written statement, Jeffrey Burstein, regional attorney for the EEOC’s New York District Office noted that, “An employer cannot substitute their own judgment when an employee is capable of working …. The ADA protects workers from such baseless fears and stereotypes.”

They’re probably foaming over that!
