DANGEROUS DOG'S DEATH MUST HAVE DOGGED HIM

NO DOG, NO PONY SHOW

In the Matter of the Town of Ogden, J. Wolf’s canine was found to be a “dangerous dog,” in violation of Agriculture & Markets Law § 123, after someone was attacked by the animal “without justification,” and serious injuries were sustained by that individual.

After Wolf’s appeal of that determination to the Monroe County Court was unsuccessful, he then went to the Appellate Division, Fourth Department. But while the appellate process was underway, the animal reportedly died.

Since there was no longer a “live controversy,” the AD4 opted to dismiss the appeal as “moot.”

In other words, the case was as dead as his dog.
