ASSAULT SURVIVERS GET MORE TIME TO BRING CLAIMS

Sexual Assault Claims Reopened

November 24 marked the beginning of the newly enacted New York Adult Survivors Act, which allows survivors of sexual abuse (over the age of 18) to file a civil claim against the perpetrator, and any enablers of the alleged abuse, no matter how long ago the incident may have occurred. (But this look-back period will end on November 23, 2023.)

While significant strides are underway, New York wasn’t always this receptive to abuse claims, as husbands could legally rape their wives up until 1984, and sexual harassment was not a violation of federal civil rights law until 1986.

According to NY Governor Kathy Hochul, “while our work is not done, eradicating sexual assault begins with our ability to bring the perpetrators of these heinous acts to justice and this legislation is a historic step forward.”
