MTVU is joining forces with Jon Bon Jovi for a promotion giving students the chance to have him perform and speak at their 2017 commencement ceremony. Beginning March 29, 2017 students can submit their entries by tweeting their best college moments using #JBJReunionContest and tagging their school. The promotion will run through Sunday, April 23 at 11:59 p.m. EDT, with the selected school to be revealed the first week of May across all MTVU platforms including Facebook, Instagram, Twitter and Snapchat. The performance will air on MTVU in June.

“Jon Bon Jovi College Commencement 2017 Promotion”

Sponsored by MTV Networks On Campus Inc. and Island Records

1. NO PURCHASE NECESSARY TO PARTICIPATE. A TWITTER ACCOUNT AND INTERNET CONNECTION IS REQUIRED TO PARTICIPATE. VOID OUTSIDE OF THE FORTY-EIGHT CONTIGUOUS UNITED STATES AND DISTRICT OF COLUMBIA, ALASKA AND HAWAII AND WHERE PROHIBITED OR RESTRICTED BY LAW.

2. Promotion Overview: “Jon Bon Jovi College Commencement 2017 Promotion” (the “Promotion”) is a social media promotion whereby college and university students are invited by mtvU to nominate their schools for the opportunity to have an on-campus appearance by musician Jon Bon Jovi to perform and speak during the Selected School’s (as defined below) 2017 commencement event.

3.Promotion Period: The Promotion commences at 12:00:01 AM Eastern Daylight Time (“EDT”) on March 27, 2017 and ends at 11:59:59 PM (EDT) on April 23, 2017 (the “ Promotion Period”). All submissions must be received by 11:59:59 PM (EDT) on April 23, 2017.

4. Eligibility: This Promotion is open to individuals who are legal residents of one (1) of the forty-eight (48) contiguous United States or the District of Columbia who are (a) at least eighteen (18) years of age at the time of participation and (b) currently enrolled as a part-time or full-time student at a nationally accredited domestic two (2) or four (4) year college or university (the “School ”) (the “Eligibility Criteria”). If a Participant (hereinafter defined) is at least eighteen (18) years of age but deemed a minor in his/her jurisdiction of residence ("Minor "), he/she must obtain parental/legal guardian consent prior to participating in this Promotion. Employees and their immediate families ( i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of MTV Networks On Campus Inc., a subsidiary of Viacom International Inc., (“MTVNOC ”), Island Records, a division of UMG Recordings, Inc., (“Island”, and together with MTVNOC, the “Sponsors”), Twitter, Inc. (“ Twitter”), and each of their respective parent companies, affiliated companies, subsidiaries, advertising agencies and third party fulfillment agencies, and each of their respective members, managers, related financing entities, agents, employees, officers, directors, successors and assigns (collectively, the “ Promotion Parties”) are not eligible to participate in this Promotion. By participating in this Promotion, Participants (as defined below): (i) agree to be bound by these Official Rules (as also published at mtvu.com\bonjovipromotion) and to MTVNOC's Privacy Policy as published at http:// www.mtvu.com/legal/privacy and by the interpretations of these Official Rules by the MTVNOC, and by the decisions of the Sponsors, which are final in all matters relating to this Promotion; (ii) release, indemnify, and hold harmless each of the Promotion Parties against any and all claims, injury or damage arising out of or relating to participation in this Promotion; and (iii) acknowledge compliance with these Official Rules and the decisions of the Sponsors, which are final and binding. Promotion is subject to all applicable federal, state and local laws.

5.How to Participate: During the Promotion Period, follow the @mtvU account on Twitter and follow the instructions in any call to action provided in the Twitter post(s) from Sponsors on such account announcing instructions about how to participate in this Promotion (the “ Call to Action Post(s)”). Calls for participation will also post from @islandrecords and @bonjovi Twitter accounts.

A Call to Action Post will call for the creation of an original photo showing your ”most memorable college moment” (the “ Submission”) which you must share via your own Twitter account along with the hashtag #JBJReunionContest (the Promotion Hashtag) and thename of the college or university that you currently attend) as further set forth below.

You must have a Twitter account to submit a Submission . If you do not have a Twitter account, visit http://www.twitter.com and follow the on-screen instructions to register for free. By sending a Submission with the Promotion Hashtag, YOU AGREE TO THESE OFFICIAL RULES. Your Twitter account privacy settings must be set to public in order for your Submission to be viewable by Sponsors.

Participants must complete their Submissions as directed and within the timeframe specified by Sponsors. The failure of a Participant to comply with the foregoing may result in an incomplete Submission.

Submissions must be posted in accordance with the Twitter Terms of Service which can be found at https://twitter.com/tos.

Participant agrees, by participating in this Promotion, that he/she is solely responsible for all data charges that may be incurred. All such charges are billed by and payable to your mobile service provider. Please contact your participating mobile service provider for pricing plans, participation status and details.

Any Participant or group of Participants suspected or found to be submitting automated Submissions of any kind will be disqualified. The person uploading the Submission will be deemed the Participant (the “ Participant”). Participant must be the only person depicted in the Submission, unless any other person appearing recognizably in the Submission has granted his/her express written permission to be included in the Submission. No person who is a minor may appear recognizably in a Submission. Participant may be required by Sponsors to furnish written evidence of an individual’s consent to be included in a Submission. A Participant may be required to show proof of being the authorized account holder of the account associated with the Submission. In the event of a dispute over who submitted a Submission, the authorized subscriber of the Twitter account (as applicable) used to participate in the Promotion at the actual time of participation will be deemed to be the Participant. The authorized account subscriber is defined as the natural person who is assigned an account by the applicable service provider.

PLEASE NOTE THAT ANY AND ALL SUBMISSIONS AND METADATA SUBMITTED FOR THIS PROMOTION MAY BE PUBLICLY VIEWABLE. IN ADDITION, PARTICIPANTS ACKNOWLEDGE THAT THEIR SUBMISSIONS MAY BE RETWEETED OR REPOSTED BY THE PUBLIC OR OPEN TO PUBLIC COMMENTARY, FOR WHICH SPONSORS SHALL NOT BE LIABLE.

Participant agrees: (i) that he/she has all rights to the contents of the Submission and all components thereof, and that Participant has obtained all rights, consents and permissions, necessary to grant the rights granted herein; (ii) that the Submission does not and will not violate any law, statute, ordinance or regulation; (iii) that the Submission is free and clear of any liens or claims with respect to the use of the Submission in the manner authorized herein and will not give rise to any claims of infringement, invasion of privacy or publicity, infringe on any rights or interests of any third party, or give rise to any claims for any payment whatsoever, including but not limited to claims for re-use fees or residuals; and (iv) that the Submission is not and will not be defamatory, trade libelous, pornographic or obscene.

Participant shall retain all copyright in and to his/her Submission; provided, however that Participant agrees that by entering into this Promotion he/she is granting Sponsors (and their respective subsidiaries and affiliates and affiliated broadcast stations and networks, successors and assignees and licensees) the non-exclusive, worldwide irrevocable right and license, but not the obligation, to exhibit, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, dub, superimpose, rebroadcast, transmit, record, publicly perform, distribute, and synchronize in timed relation to visual elements, the Submissions and/or any portions or excerpts thereof, in any manner, an unlimited number of times, in any and all media, now known or hereafter devised for any purpose, throughout the world in perpetuity. Sponsors may use the Submissions (or any portion thereof, including, without limitation, a Participant’s Twitter screen name) to advertise, promote and publicize, the Promotion, Sponsors’ business, products and worldwide programming services and/or Sponsors’ websites in all media throughout the universe and may authorize others to do so; such advertising, promotion and publicity may include portions and excerpts, in addition to cut-in, synchronized, dubbed and superimposed versions of the Submissions. The Participant acknowledges that Sponsors may use the Submissions in accordance with the permissions granted herein without any payment to the undersigned or any third party.

Participants agree that Submissions shall not contain, include or involve any of the following:

· Gratuitous obscenity

· Crude, vulgar or offensive pictures, depictions, images, language and/or symbols

· Gang signs or symbols

· Excessive, extreme or gratuitous violence

· Glamorization of illegal drug or alcohol use

· Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements

· Unauthorized trademarks and copyrighted material (e.g., music, etc.)

· License plates, phone numbers, personal addresses – physical, email or otherwise

· Website or web page links

· Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliations of other people (publicly or otherwise), or any assault or threatening of others

· Trespass or the violation of other people’s rights or property

  • Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress)

· Conduct or activities in violation of these Official Rules

· Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable, or offensive, as determined by Sponsors in their sole discretion

· Any person appearing recognizably in a Submission unless he/she has granted his/her prior consent

  • Any minors

· Language and themes contained in Submissions will be evaluated by Sponsors based on content and societal acceptability.

Sponsors are not obligated to, use, publish, display or broadcast any Submission (in whole or in part). Each Participant acknowledges that Sponsors will rely on such Participant’s agreement and compliance with these Official Rules when Participant submits or attempts to submit the Submission. Sponsors reserve the right to reject any Submission that they deem, in their sole discretion, to violate any of its standards and practices policies or the terms and conditions set forth in these Official Rules. Sponsors may modify or edit any materials related to a Submission or request Participants to do so, so that such materials meet such guidelines.

In submitting a Submission into this Promotion, each Participant agrees to, confirms and represents to Sponsors that neither he/she nor anyone else has engaged or taken part in (or induced or encouraged anyone else to do so) in any activity or conduct in connection with this Promotion that: (A) may or is likely to harm or create a risk of harm, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person, other living thing or any property; (B) may/or is likely to create a risk of any other loss or damage to person, living things or property; (C) is or may constitute a crime, unlawful or non-consensual activities (e.g., conduct that could lead to criminal prosecution), tortuous conduct (e.g., conduct that could lead to civil prosecution) or the violation or infringement of the rights of any other party; or (D) violates any of the terms or conditions of these Official Rules.

6. School Selection and Notification. There will be one (1) college or university chosen as the designated recipient of the “Promotional Opportunity” (hereinafter defined) (the “ Selected School”) from among all schools referenced in all Submissions. A team of representatives of MTVNOC’s production and editorial staff team, in consultation with Island, will determine the Selected School after reviewing the list of all School’s referenced in all Submissions and selecting the one which has received the most support by Participants (by way of frequency of mentions in all Submissions received) and contingent upon the feasibility of awarding the Promotional Opportunity. Feasibility will be determined by Sponsors, in their sole discretion, based on timing and location logistics in addition to the ability to secure all required administration approvals from the potential Selected School. Additionally, Sponsors will reach out to up to twenty (20) alternate potential Schools (the “Runner Ups”) who will be considered potential Selected School(s) in the event that the initial Selected School is unable to be contacted, verified, fail to meet the eligibility requirements set forth in these Official Rules, or who is otherwise unable or unwilling to accept the Promotional Opportunity. Runner Ups will be ranked based on highest to lowest based on the number of School’s name references from among all Submissions.

The final determination of the Selected School shall be in the sole and absolute discretion of Sponsors. Sponsors reserve the right to extend the Promotion Period if Sponsors determine, in their sole and absolute discretion, that Submissions received did not meet the minimum qualification standards based on the Submission Requirements specified herein or if there are an insufficient number of Submissions. Sponsor reserves the right to select an alternate Selected School in the event that an originally selected Selected School fails to comply with these Official Rules. The Selected School will be selected by Sponsors on or around April 26, 2017.

MTVNOC will attempt to contact the potential Selected School over a period of about three (3) days commencing on or around April 24, 2017. If a potential Selected School cannot be reached directly by April 27, 2017 an alternate Selected School will be selected from among the Runner Ups. This process will be repeated until a potential Selected School has responded and MTVNOC has received all required verifications and approvals from all necessary School officials and administrators, as time permits, in MTVNOC’s sole discretion. Sponsors expressly reserve the right to delay the announcement of the Selected School for creative or technical reasons or for any other reason Sponsors deem necessary.

7.Promotional Opportunity: The Selected School will receive the opportunity to have Jon Bon Jovi attend its 2017 commencement ceremony and deliver a commencement speech between the dates of May 1, 2017 and June 30, 2017 and perform two (2) songs of his choosing (the foregoing, the “Promotional Opportunity”). The awarding of the Promotional Opportunity is conditioned upon such School’s approval and acceptance of the Promotional Opportunity and the terms associated therewith and such School will be required to complete any legal documents provided by Sponsors evidencing the same. An authorized representative(s) of the Selected School (the “ School Representative”) must execute (a) an affidavit of eligibility and release of Sponsors and Viacom International Inc., and their respective corporate parents, subsidiaries affiliated entities, advertising agencies, promotional agencies and their respective employees, from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Promotion or the use or acceptance of the Promotional Opportunity, to be eligible for the Promotional Opportunity, as applicable; (b) except where prohibited, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation and (c) all necessary premises/location agreements permitting Sponsor to occupy the Selected School’s premises to videotape, photograph, film and/or otherwise record the fulfillment of the Promotional Opportunity.

Sponsors anticipate that the events surrounding the Promotional Opportunity will be recorded for broadcast on MTVU within the month of June 2017 (“ Sponsor Programming”). However, Sponsors make no guarantee that any footage capturing the Promotional Opportunity will appear on-air.

All details related to the Promotional Opportunity, dates and arrangements are subject to change based on availability and all required approvals. Any portion of the Promotional Opportunity not accepted by the Selected School will be forfeited. If the Promotional Opportunity is forfeited in its entirety, and there is sufficient time to determine and notify an alternate Selected School, the Promotional Opportunity may be awarded to an alternate Selected School. A potential Selected School is not a recipient of the Promotional Opportunity until it has been verified as the Selected School by the Sponsors. If for any reason whatsoever, Selected School is unable to utilize any services or portions of the Promotional Opportunity after all arrangements have been made and paid, Sponsors shall have no further obligation to it. None of the Promotion Parties shall be responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to the prizing. Any details related to the Promotional Opportunity not specified herein shall be determined by Sponsors in their sole discretion. No substitution, transfer or cash equivalent of the Promotional Opportunity or any portion thereof is permitted, except by Sponsors, as determined in its sole discretion .

8. General Terms: The specific elements of the Promotional Opportunity are subject to the Selected School’s policies and regulations. Sponsors shall not be responsible for non-fulfillment of any element of the Promotional Opportunity to Selected School’s rejection or restriction of the same. The date for fulfillment of the Promotional Opportunity will be sometime between May 1, 2017 and June 30, 2017 subject to change in Sponsors’ sole discretion. Arrangements for the fulfillment of the Promotional Opportunity will be made by Sponsors or a third party on Sponsors behalf. If for any reason any element of the Promotional Opportunity is delayed, cancelled or postponed, or, if in the unforeseen event that Jon Bon Jovi should become unavailable for any reason at the time of the scheduled Promotional Opportunity fulfillment, Sponsors reserve the right, but are not obligated, to cancel or modify the Promotion in their discretion.

Noncompliance by any Participant with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A PARTICIPANT OR ANY BEHAVIOR BY A PARTICIPANT THAT MAY, IN ANY OF THE PROMOTION PARTIES’ GOOD FAITH DETERMINATION, BRING ANY OF THE PROMOTION PARTIES, OR ANY OTHER ACTIVITY RELATED TO THE PROMOTION OR THE PROMOTIONAL OPPORTUNITY INTO DISREPUTE OR OTHERWISE SHED A NEGATIVE LIGHT ONTO ANY OF THE PROMOTION PARTIES, OR ANY OTHER ACTIVITIES ASSOCIATED WITH THE PROMOTION WILL RESULT IN SUCH SELECTED SCHOOLS’S DISQUALIFICATION AS A POTENTIAL RECIPIENT OF THE PROMOTIONAL OPPORTUNITY OF THIS PROMOTION AND ALL ASSOCIATED BENEFITS AND/OR PRIVILEGES AS THE SELECTED SCHOOL WILL BE IMMEDIATELY TERMINATED.

The Promotion Parties assume no responsibility for incorrect or inaccurate Submission information, whether caused by any of the equipment or programming associated with or utilized in this Promotion or by any human error which may occur in the processing of the Submissions in this Promotion. The Promotion Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, or any incomplete, lost, late, delayed, misdirected or garbled Submissions or failure to receive Submissions, including, without limitation, any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of any Promotion-related materials, administration of the Promotion, or in the announcement of the Promotional Opportunity. If, for any reason, the Promotion is not capable of running as planned, including, without limitation, changes in MTVNOC’s programming, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promotion Parties which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion or for any reason that Sponsors deem necessary, Sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, and to determine the Selected School in their sole discretion. Should the Promotion be modified or terminated prior to the stated expiration date, notice will be given by Sponsors via Sponsors’ respective Twitter accounts and the Promotional Opportunity may be awarded to a School to be selected from among all Submissions received up until and/or after (if applicable) the time of modification, cancellation or termination, as determined by Sponsors. All interpretations of these Official Rules by Sponsors and decisions of Sponsors are final. Sponsors reserve the right in their sole discretion to disqualify any individual they suspects or find: (a) to have used a software generated, robotic, programmed, script, macro or other automated Submission, (b) to have tampered with the participation process or the operation of the Promotion, (c) to be acting in violation of these Official Rules, (d) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) to have provided inaccurate information on any legal documents submitted in connection with the Promotion.
