ASSAULTER GETS TIME

DA VANCE: THOMAS HOEY SENTENCED TO 1 ⅓-TO-4 YEARS IN STATE PRISON FOR ASSAULTING GIRLFRIEND, TAMPERING WITH EVIDENCE

Manhattan District Attorney Cyrus R. Vance, Jr., recently announced the sentencing of THOMAS HOEY, 46, to 1 ⅓-to-4 years in state prison for assaulting his girlfriend in their Upper East Side apartment building, and tampering with evidence of his crime. On May 21, 2014, a New York State Supreme Court jury convicted HOEY of both charges in the indictment against him: Tampering with Physical Evidence and Assault in the Third Degree.

“This case is the perfect example of the work my Office’s Domestic Violence Unit does each and every day to protect victims of violent crimes,” said District Attorney Vance. “The victim in this instance was beaten but never disclosed the abuse to law enforcement. Sadly, this case is not unusual.

“It is our responsibility to protect victims, even when they are afraid to pursue prosecution or do not cooperate with law enforcement. Since the creation of the Special Victims Bureau in 2010, my Office has increasingly relied on evidence-based prosecutions to aggressively prosecute offenders. As proven at trial, at approximately 10 p.m. on March 30, 2012, HOEY assaulted his girlfriend in their East 91st Street apartment building. A neighbor observed the aftermath of the attack, including blood on the stairwell floor, and called 911. The neighbor returned to the stairwell while on the phone with a 911 operator, and observed HOEY attempting to clean the trail of blood leading from the stairwell to his apartment.

Assistant District Attorney Laura Millendorf handled the prosecution of this case under the supervision of Assistant District Attorney Lawrence Newman, Chief of the Domestic Violence Unit, Executive Assistant District Attorney Audrey Moore, Chief of the Special Victims Bureau, and Executive Assistant District Attorney John Irwin, Chief of the Trial Division.
