After Rocky Point Realty entered into a 15-year lease with a “national auto parts retailer,” the Town of Brookhaven condemned the property for public use.

When the former owner sought to recover damages for the "taking," the Suffolk County Supreme Court eventually awarded $1,120,125 as “just compensation.”

Since the court’s award was within the range of expert testimony and adequately explained by the court, the Appellate Division, Second Department, left the assessment undisturbed.
