TAKING THE INITIATIVE

When 33 West 122 nd Street HDFC, a cooperative, offered him a renewal lease which had a steep rent increase, Lavord H. declined to sign or accept the agreement. And when the New York County Civil Court later dismissed a holdover case which the HDFC brought against the tenant, an appeal followed.

The Appellate Term, First Department, was of the view that the trial court improperly found that the renewal was “unconscionable,” (absent any evidence in that regard and without any finding as to whether the tenant's refusal to renew was otherwise justified). As a result, the AT1 sent the case back for a new trial.
