After the Police Board of Trustees denied Mary Ginther's request for accidental disability retirement benefits, she asked the New York County Supreme Court to review her case. And when her request for relief was denied, she appealed.
Although the Board claimed that Ginther was suffering from a "personality disorder" (rather than "post-traumatic stress disorder"), since there was no "credible or competent medical evidence" presented in support of the Board's position, the Appellate Division, First Department, reversed and ordered that relief be granted in the lady's favor.
