When a building's roof collapsed, construction worker Julio Cueva fell to the ground floor and was injured. In a lawsuit later filed against his employer, the Kings County Supreme Court concluded that the company had violated a state law which requires that workers be given "reasonable and adequate protection and safety" on a job site.
On appeal, the Appellate Division, Second Department, agreed that because the company had failed to ensure the existence of "sound roofing," liability for Cueva's injuries attached.
