TIANNA'S TROUBLES

Because she admitted to using a cigarette lighter to burn marks on her school's wall, Tianna W. was found to be a "juvenile delinquent" and ordered to remain in the custody of Clinton County's Department of Social Services for one year.

Since her conduct would have amounted to "criminal mischief in the fourth degree" had she been an adult, and given the youngster's history--which included substance abuse and unexcused school absences--the Appellate Division, Third Department, refused to apply a "less restrictive option," such as placing the kid in her mom's custody. (Apparently, the court didn't think her parents could provide the necessary "supervision, structure and assistance" that Tianna required.)

That was far from minor.
