After the Unemployment Insurance Appeal Board concluded that Village Wine Imports was liable for an "independent contractor's" unemployment insurance contributions, an appeal followed.

Because the company provided training, set the saleperson's commission rate, gave him sale leads, pre-approved all sales, reimbursed him for travel and other expenses, and even supplied business cards, the Appellate Division, Third Department, agreed that the relationship was more of an "employer-employee" and that liability appropriately attached.
