On appeal of his conviction of obstructing governmental administration in the second degree, James Small claimed that the jury verdict was erroneous.
Since cops lacked a "reasonable suspicion" to pursue the guy, the Appellate Division, Second Department, agreed that Small had been wrongfully convicted -- particularly given that he hadn't been carrying a weapon.
