STANDING IN THE WAY?

Ann Belaska, a clerk for the New York State Department of Law, was seriously injured when she was assaulted by a fellow passenger while riding a shuttle bus (after work) to a satellite parking lot. And when the Workers' Compensation Board later denied her benefits claim on the grounds her injury wasn't employment related, the lady appealed.

Because it thought the evidence supported the Board's determination that the assault arose from "personal hostilities," which had nothing to do with Ann's work, the Appellate Division, Third Department, allowed the denial to stand.
