The Broome County Supreme Court granted Phelps Corporation's foreclosure request after finding that Robert D. Jones hadn't honored his mortgage obligations.
And on appeal, the Appellate Division, Third Department, agreed that all the underlying documentary evidence (relating to the debt and the collateral) was in order (and had been properly recorded) and that Jones hadn't presented a bonafide defense to the dispute.
