Kim Moore was injured when he crashed into the back of Kuldip Singh's cargo van. And after the Orange County Supreme Court granted Singh's request to have the case dismissed, Moore appealed.

Because Singh established that he had been stopped for some 20 seconds before the collision occurred, the Appellate Division, Second Department, left the dismissal undisturbed. (Apparently, the AD2 thought that Kim hadn't been at a "reasonably safe distance," or driving at an appropriate rate of speed.)

No giving him Moore?
