
Hector Huaman was injured when his slacks got caught in a wire which was protruding from Marie Veronica Tierney's fence.
After the Westchester County Supreme Court denied Marie's request to dismiss the case, she appealed to the Appellate Division, Second Department, which sided with the lady and threw the negligence case out--because the property owner had had no "actual or constructive notice" of a problem.
