Reginald Horne was found guilty of violating several prison disciplinary rules, after a "broken toothbrush with a sharpened tweezer half taped to the handle," was found in his cell.
On administrative appeal, the Albany County Supreme Court referred the matter to the Appellate Division, Third Department, which rejected Horne's argument that there wasn't enough evidence to support the outcome.
Although there were "gaps" in the hearing transcript, the AD3 didn't think that prevented a "meaningful review," particularly in light of the extensiveness of the underlying record--which included an array of documents (including a misbehavior report), and the testimony of the correction officers.
