Linda L. Robinson sued her former employer, Orleans Men’s Correctional Facility, alleging that she was the victim of unlawful discrimination -- based on her sex, age, and disability -- and suffered “retaliation” for speaking up about the purported misconduct.
When Robinson tried to get hold of her supervisor’s medical records both the Monroe County Supreme Court and the Appellate Division, Fourth Department, dened that request.
Even though the supervisor might have waived any privilege with respect to those records in an unrelated federal lawsuit, the AD4 concluded that Robinson still needed to make an “evidentiary showing” that those records were pertinent to the litigation.
No disputing that.
