The Alien Tort Statute ("ATS") has been used as a jurisdictional basis for foreign plaintiffs to sue multinational corporations in U.S. courts over their alleged violations of international law. In April 2013, the United States Supreme Court, in Kiobel v. Royal Dutch Petroleum Co., issued a ruling limiting the extraterritorial application of the ATS. The Court's decision continues a recent trend by federal courts of invoking the presumption against the extraterritorial application of U.S. laws.
The panel, composed of members of the ATS plaintiffs' bar, defense bar, and academia, will discuss and debate the scope of the Kiobel holding and the future of the ATS litigation and other U.S. litigation.
