After he was assaulted in his dorm room, Christopher Walton sued Mercy College for damages.
While there was evidence of prior crimes in the area, both the Bronx County Supreme Court and the Appellate Division, First Department, thought that the assault on Walton wasn't "foreseeable" because those other criminal acts weren't sufficiently similar to what happened to the student. (The fact that the assailants were "guests" of another student--rather than intruders--also worked to shield the school from any liability.)
