Because he was supposedly circulating "unauthorized organizational materials," inmate Melvin Kimbrough was found guilty of violating several prison disciplinary rules.
When Melvin challenged that determination -- by way of a special proceeding brought pursuant to CPLR Article 78-- the Albany County Supreme Court referred the matter to the Appellate Division, Third Department, which ultimately didn't think there was a sufficient legal basis to support the outcome.
Since the booklet in dispute neither referred to an organization nor advocated "violence or acts of disobedience," the AD3 sided with Melvin and expunged the charges.
Looks like he played by the book.
