NYC Police Officer Russel Timoshenko was shot dead as he approached the passenger side of Dexter Bostic's vehicle.

When the officer's family later filed suit, claiming that Dexter's employer--Airport Auto Group--was liable for the shooting (because the company had been negligent in hiring and supervising its employee), the Richmond County Supreme Court refused to dismiss the case.

But because the incident occurred off-premises, during non-business hours, and wasn't in furtherance of the Dexter's employment, the Appellate Division, Second Department, concluded that Auto Group bore no legal responsibility for what had happened.

That was a killer.
