Marcia Fajardo sued the City of New York after a fire rescue truck crashed into the back of her car as she was changing lanes on Queens Boulevard. When the Queens County Supreme Court later dismissed her suit, Fajardo appealed.
While emergency vehicles are exempt from certain rules of the road, their drivers must still comply with other laws--like not rear-ending another vehicle. Since the Fire Department couldn't offer an acceptable explanation for what had happened, the Appellate Division, Second Department, reinstated the case.
They A.D. sure put out that fire.
