While on "special watch," inmate William Fero ignored a correction officer's instructions not to urinate on the prison floor.
After Fero was found guilty of disregarding a direct order, and committing an unhygienic act, he disputed the outcome by way of an administrative proceeding which was transferred by the Albany County Supreme Court to the Appellate Division, Third Department.
Since he had pleaded guilty to an "unhygienic act," he couldn't challenge that particular charge. And because the AD3 thought that the record contained "substantial evidence" of his other misconduct, the underlying determination was affirmed.
