Ann Turton sued the New York City Transit Authority (NYCTA) seeking to recover damages after she was assaulted in front of a subway token booth.
But both the Queens County Supreme Court and the Appellate Division, Second Department, were of the view NYCTA owed no duty to protect the lady from assault -- particularly in the absence of a "special relationship." And because Ann couldn't show that the Authority's employee had failed to seek assistance in a "timely manner," no liability could attach.
That got derailed.
