Dr. C.K.--a psychologist who suffered from acute back pain and underwent several related surgeries--was denied disability retirement benefits by the New York State & Local Retirement System and the State Comptroller's office because she couldn't demonstrate she had been "permanently incapacitated."

When she later appealed, the Albany County Supreme Court transferred the matter to the Appellate Division, Third Department, which agreed that the lady's medical evidence hadn't established the requisite degree of "permanency."
