
Sharon Inger was brutally murdered at the end of her shift at a mall restaurant. When her family later filed a lawsuit, they claimed that the property's owner--PCK Development Co.--had failed to maintain adequate security.
After the Ulster County Supreme Court declined the company's request to dismiss the case, an appeal followed.
Because a security guard patrolled the area after hours, and there was no prior notice of a possible attack, the Appellate Division, Third Department, didn't think the lawsuit could survive. In the absence of a similar incident, it was of the view the owner couldn't have anticipated what transpired.
