An inmate -- Anpu Unnefer Amen -- was found guilty of violating several disciplinary rules because he was caught selling a "litigation manual" he had authored, and had other prohibited materials in his possession.
When Amen challenged that determination by way of a special proceeding (brought pursuant to CPLR Article 78), the Albany County Supreme Court referred the case to the Appellate Division, Third Department.
Based on its review of record -- which included detailed misbehavior reports, the testimony of correction officers, and other documentary evidence-- the AD3 thought that the outcome was supported by "substantial evidence," and closed the book on the guy's challenge.
