After the District Court of Suffolk County (Second District) found Frances Zito guilty of "the outdoor storage, deposit, placement or maintenance of debris" on her property, she appealed to the Appellate Term, Second Department, claiming there wasn't enough evidence to support her conviction.
Since the stuff was observed on Zito's property on only one occasion, the AT2 didn't think that measured up to the "sense of permanence" needed for a conviction. (There was also no evidence that Zito placed the items on her property.)
That's garbage!
