
Because the company supposedly created a dangerous condition--by leaving "car parts" on the road--Donald Rozz sued Village Auto Body Works, Inc., after his son got into a crash on the Seaford Oyster Bay Expressway (SOBE).
Both the Nassau County District Court and the Appellate Term, Second Department, thought Rozz wasn't able to prove that Village Auto Body was responsible for his son's collision--particularly since the company hadn't been at the scene for some six days.
