Grace Scott thought she was refinancing her home, but ended up transferring her property to Sherran Fields.
When she later filed suit, Grace claimed that an employee of C & C Homes--the real-estate company that had arranged the transaction--had told her that, in order to get the loan, Fields's name needed to be on the deed for three to six months.
Although the Nassau County Supreme Court threw the lady's case out, because it didn't think she had made out a proper "fraud" claim, the Appellate Division, Second Department, thought otherwise and reinstated the litigation.
