After Leroy Henderson died at Kingsbrook Jewish Medical Center, his remains were held by the hospital for some three days before being released to family members.
After the Kings County Supreme Court threw out his family's negligence case, the Appellate Division, Second Department, thought Leroy's kids had presented a viable claim based on a violation of their "right of sepulcher"--a legal entitlement to the immediate release of a relatives's remains for preservation and burial.
Bet Kingsbrook wishes they could bury that.
