motorbike_toy_nyreblog_com_.JPGAfter failing his motorcycle road test, Thomas Appollonia hopped on his Kawasaki for a ride through Kingston.As he was coming out of a turn, Appollonia suddenly encountered a stopped truck, "panicked," hit the brakes, lost control of his bike, crashed into the back of the other vehicle, flipped over his bike's handlebars, and landed on the road.

Both the Ulster County Supreme Court and the Appellate Division, Third Department, were of the view Appollonia failed to operate his bike with "reasonable care" and that he lacked a "nonnegligent explanation" for the collision.

Guess he wasn't riding his luck.
