
After she fell to the basement through a trapdoor, Modesta Brignoni sued 601 West 162 Associates, L.P.
While the New York County Supreme Court didn't think she had a case, the Appellate Division, First Department, ended up reinstating the litigation because the building's property manager and superintendent had known that the trapdoor's hinges were old and rusty. (The AD1 thought a jury could find that the landlord had notice of the "defective condition.")
No making her disappear.
