Paul Sama sued his mother, Celeste, after he fell off a ladder while trimming tree branches at her home. (Paul claimed that the hinges snapped, causing him to drop to the ground.)
Although the Westchester County Supreme Court wanted to keep Celeste's dough in the mix, the Appellate Division, Second Department, thought otherwise.
Without any evidence that his mom broke the ladder, or knew it was in disrepair, the AD2 was of the view she should be sliced right out of the case.
