Angela Cassone, a breast-cancer walk participant, tripped and fell over an orange cone placed on the boardwalk at Jones' Beach State Park. When she and her husband later sued the State of New York, the Court of Claims granted the government's request to have the case thrown out.
While the State contended the cone was readily visible, because Cassone showed that her view of the object had been blocked by the large crowd around her, the Appellate Division, Second Department, didn't think an entitlement to dismissal had conclusively established.
