Jaclyn Donnelly sued her ex-boyfriend, after she was assaulted by his newest beau and two of her female companions. And when the Nassau County Supreme Court granted the guy's request to be let out of the case, Donnelly appealed.
Even though he was at the scene of the assault, because he wasn't responsible for what unfolded, nor legally required to protect his "ex," the Appellate Division, Second Department, agreed he wasn't liable for the lady's injuries.
