When the jury decided that Weil wasn't at fault for what happened, and the Suffolk County Supreme Court refused to set that verdict aside, Meyer and Cox appealed.

Since the outcome was based on a "fair interpretation of the evidence," the Appellate Division, Second Department, deferred to the jury's determination that Meyer had driven through a red light and that Weil had the right-of-way when he entered the intersection.
