When the Board of Education ended his employment as a New York City schoolteacher because of alleged "sexual misconduct," Keith Douglas asked the New York County Supreme Court to set aside the Board's decision. And after that request was denied, Douglas appealed.
Although there were inconsistencies in the students' testimony, the Appellate Division, First Department, deferred to the Hearing Officer's credibility assessments and "independent findings," and allowed the outcome to stand.
