After she was assaulted by another tenant, Pamela Reinert sued her building's landlord--291 Pleasant Avenue LLC--seeking compensation for her injuries.
When the New York County Civil Court sided with the owner and dismissed the case, Pamela appealed.
Since she had informed the landlord of the other tenant's verbal abuse, vandalism, and prior assault, the Appellate Term, First Department, thought dismissal of the litigation--before trial--was premature. (It also was of the view the owner's duty and ability to control the assaulter was an issue for a judge or jury to decide.)
That was quite unPleasant.
