Cliff Chan sued Wintech Systems (his alarm system installer), and Counterforce Central Alarm Services (the company responsible for monitoring the alarm), after his home was burglarized. And when the Nassau County Supreme Court later dismissed his case, Chan appealed.
Since he wasn't able to show that the companies acted with "gross negligence" or "reckless disregard" of their contractual responsibilities, the Appellate Division, Second Department, agreed that dismissal was appropriate--particularly since the governing agreement exempted the defendants from any liability for "ordinary negligence."
