empty_gas_tank_gauge_photo_nyreblog_com_.JPGJust before a robbery was announced over the police radio, an officer saw Aries Palmer "sprinting" by, and after hearing the perpetrator's description, Aries was apprehended and identified by the victim--all within a span of about five minutes.

After the Queens County Supreme Court convicted Aries of "second degree robbery," he appealed, arguing the officer lacked a legal basis to detain him, but the Appellate Division, Second Department, didn't agree.

The broadcasted description, Palmer's proximity to the crime scene, and the immediacy of the apprehension, identification, and arrest, all worked to reinforce the propriety of the officer's conduct.
