Carmen Santos Lopez sued the Metropolitan Transit Authority after a bus supposedly failed to stop at a crosswalk and injured her child.
Although the driver claimed he had a green light, and his testimony was buttressed by an accident report and an officer's testimony, a Bronx County Supreme Court jury still went with the kid's testimony (and that of a witness) that the light was in the youngster's favor.
Since the jury was free to accept the evidence in whole or in part, the Appellate Division, First Department, left the outcome undisturbed. (It didn't think that an "emergency doctrine" defense applied, because it was of the view that drivers have to be prepared to "deal with" pedestrians at crosswalks.)
