When he exited his taxi to help a passenger, Ibrahima Konate left his vehicle in drive, which caused the car to lunge forward and injure Marie Soho's leg.
After the Bronx County Supreme Court dismissed her negligence case, on the grounds that she hadn't suffered a "serious injury," the lady appealed.
Since the evidence established that Soho's injures were the result of a pre-existing condition consistent with her advanced age, the Appellate Division, First Department, affirmed the dismissal.
