When Abraham Natural Foods Corporation (ANFC) got embroiled in a lawsuit, it asked the Queens County Supreme Court to find that Mount Vernon Fire Insurance Co. was obligated to indemnify and defend. And, when that request was denied, ANFC appealed.
Since the claim had been "preexisting," and was excluded from coverage, the Appellate Division, Second Department, agreed that the ANFC was going to have to use its own dough.
