Although he was found driving a car which contained millions of dollars worth of cocaine, because he hadn't been shown to be a "manager" of a "large-scale drug organization," German Rios-Davilla asked that he be resentenced under the State's "Drug Law Reform Act."
When the New York County Supreme Court denied that request, German appealed.
Since the evidence established that German was actively involved in a large-scale drug-trafficking operation, the Appellate Division, First Department, thought that the guy's exact role wasn't relevant, and that the extent of his participation was enough to justify his sentence.
