When George Kalpakis transferred property to Bette Kalpakis, the guy had apparently been dead for some eight years.
So when a bank later sued Bette to foreclose on a mortgage which had taken out on the property, three of George's surviving relatives asked the Suffolk County Supreme Court to invalidate the conveyance. And after the Supreme Court obliged, the bank appealed.
Because the remaining family members went to court within two years of discovering the alleged fraud, and the bank didn't show the purported misconduct could have discovered any sooner, the Appellate Division, Second Department, didn't think George's kids were somehow time-barred from seeking relief.
In other words, the case survives.
