Even though Bryant Installations (BI) failed to respond to a fraud and breach of contract lawsuit filed by the Church of South India Malayalam Congregation, the Nassau County Supreme Court refused to enter a default judgment against the company.
Since BI was given notice of the case's pendency, the Appellate Division, Second Department, thought a default judgment for contract breach was warranted. But because the Church's fraud claims weren't sufficiently established, nor distinct from the breach of contract claim to warrant relief in its favor, the AD2 left that part of the lower court's determination undisturbed.
So much for going BI.
