Judy L. New lost her balance and tumbled down a flight of stairs after a doorknob she was holding gave way and fell off.
When she later filed a personal-injury suit against the landlord, the Orange County Supreme Court dismissed her case. But on appeal, the Appellate Division, Second Department, thought there were unresolved questions as to the incident's forseeability, and whether the property owner or managing agent had notice of the condition which led to the lady's fall.
